Policy Statement

This policy statement sets out the manner in which Onzo Limited and its associated companies (“Onzo”) deals with its intellectual property rights (“IPR”), including how it procures, enforces and otherwise deals with IPR.

As a highly innovative company, Onzo invests significant amounts of engineering and financial resources into developing its technologies and believes strongly in aggressively securing, exploiting and, where necessary, enforcing its IPR to further the interests of the company and protect its freedom to operate.

Onzo technologies offer significant market and technological advantages that are protected by its IPR and the company is committed to preserving and enhancing its competitive position through strategic IP portfolio management. This policy is indicative only and Onzo reserves the right to take such actions and/or assert its intellectual property rights as it sees fit without prior notice.

IP rights are critical to our technology offering

Onzo deals with all types of intellectual property. Significantly, Onzo controls a growing number of international patent families and other IP relating, for example, to innovations in:

  • technologies for deriving consumer level consumption intelligence
  • technologies for harvesting consumer level consumption data
  • technologies for processing and deriving meaningful information from consumption data
  • technologies relating to the appliance inference
  • technologies relating to utilities management

Onzo's international patent rights include a number of PCT families, each of which is directed to a number of different inventions deemed core to our business operations.

Onzo is also the owner of further IPRs that protect its hardware and software technologies, business process, brands and other valuable business assets including but not limited to copyright, designs, trade mark rights, rights in passing off and unfair competition, trade secrets, and database rights.

Enforcement

Unauthorized use of Onzo’s IPR damages not only Onzo and its partners but the industry as a whole. The company does not tolerate unauthorized infringements of its IPR (such as infringement of rights or breach of confidentiality provisions) and will pursue infringers to obtain resolution. In such circumstances, Onzo reserves the right to seek legal remedies and relief to the fullest extent possible, including injunctions, damages (and exemplary or enhanced damages if applicable) or an account of the infringer’s profits, and enforcement costs. Onzo continually monitors and reviews potentially infringing activities and has financial provision and management approval for taking legal action internationally, without notice if necessary.

Licensing

Under certain circumstances, Onzo may be willing to enter into licensing arrangements to allow third parties to use certain Onzo IPR. However, Onzo only grants licences in writing and each licence will be subject to formally agreed terms and conditions, and approved by the board. This statement is not to be regarded as any type of waiver of any right nor is it to be regarded as an offer of a licence and each approach will be treated on its own merits. Third Party Rights

In certain circumstances, Onzo’s processes may involve the use of third party IPR, such as authorised use of IPR belonging to our partners. It is Onzo’s policy to respect third party IPR and not knowingly to infringe any such IPR. We take appropriate steps to minimise the risk of infringing third party IPR. If a third party is aware of any of their IPR being used in an unauthorized manner in connection with Onzo’s business, they are requested to contact Onzo's Commercial Director Abraham Myer, who will investigate the situation and will, if appropriate, unilaterally suspend relevant activities.
